Avid Life Media (Avid), the parent company of Ashley Madison – the infidelity website that made headlines across the globe when hackers revealed its users’ private information – has put out a reward for anyone who brings forth information on the culprits, according to a recent Fortune Magazine report. Avid has offered $377,000 for information to help catch the hackers who leaked the information; at least two suicides have been reported as a result of the data breach.

The Ashley Madison hackers posted the personal information of subscribers to the extramarital affair website including account details such as user profiles, transactions, credit card data, and email addresses. The damage is reported to have included data from 32 million of the website’s members. The reasoning behind the hack, according to the report was twofold: 1) simply because Ashley Madison’s purpose is to arrange affairs between married people and 2) the company requires users pay a monthly fee so that all of their information is deleted from the website when in fact, as clearly shown by the hack, not all the data was scrubbed.

Increase in Divorces Expected

According to the International Business Times, the resulting hack is expected to bring about a surge of divorces due to the nature of the organization’s membership. A majority of jurisdictions nationwide follow no-fault divorce doctrine. New York allows for no-fault and at-fault divorces. In other words, a person seeking a divorce can prove specified grounds to a judge or can seek a no-fault divorce.

  • At-fault divorce: there are several reasons that can be established in an at-fault divorce including cruel and inhuman treatment, abandonment, imprisonment for three consecutive years, and adultery.
  • No-fault divorce: the legal term used is “irretrievably broken” marriage; the relationship must be irretrievably broken for at least six months in order to put forth this ground. The pair does not have to be separated for this amount of time. Under this rule, the court does not need to determine which spouse is at fault for the breakup.

Infidelity can, however, affect other aspects of a no-fault divorce, depending on the case. For example, a New York judge can look at the moral fitness of the parent when determining child custody, alimony awards, and property division. In fact, under state law, the court can consider any other factor that it finds to be just and proper.
