A recent ABC News feature reported that Liana Barrientos, 39, pled not guilty at her arraignment last month for providing false information on her most recent marriage license. Her tenth marriage license application since 1999 was filed in the Bronx in 2010. That’s when it was discovered that she had been married previously, and had divorced only one of her prior spouses. Nine of her 10 marriages happened between 1999 and 2002. Barrientos used her actual Social Security number on every application and never changed her first or last name in any of her marriages, although the spelling varied. She falsely stated in her marriage license applications that she had not been previously married. If convicted, Barrientos could face four years in jail.

Under New York law, a person may file for divorce if:
- The filer and the spouse have lived apart for at least one year and they have a separation agreement
- The filer and the spouse have not lived together for at least one year due to a judgment of separation

- A spouse has been imprisoned for more than three years

One of the following must apply in order to qualify for a divorce in New York: the marriage occurred in NY and one spouse has lived in the state for at least one year; the couple lived in NY as spouses and either one has lived in the state for at least one year; or either spouse has lived in NY for at least one year.
While there is no formal waiting period for a judge to enter a divorce decree, there are waiting times that some states require after being divorced before someone can remarry. New York, specifically, requires certified documents to show how the previous marriage ended.
