Step 1: Locate the Will and Important Documents

The will should name you as executor. You’ll also need:

  • Death certificate

  • List of assets

  • Contact information for beneficiaries

Step 2: File for Probate in Kings County

To start the process, file a Petition for Probate in Brooklyn’s Surrogate’s Court. This officially gives you the authority to act as executor.

You’ll then receive Letters Testamentary, which allow you to access accounts, sell property, and pay bills.

Step 3: Notify Heirs and Creditors

You're legally required to:

  • Notify all heirs and beneficiaries

  • Publish a notice to creditors

  • Begin inventorying assets

Step 4: Pay Debts and Taxes

Before distributing anything, you must:

  • Pay valid claims

  • File final income taxes

  • Handle estate tax filings if applicable

Step 5: Distribute the Inheritance

Only after settling the estate can you distribute assets. Keep detailed records—especially if there are multiple heirs.
